‘CHILLING EFFECT ON THE RIGHT TO PEACEFUL PROTEST’ AS ANTI FRACKING CAMPAIGNERS FACE TRIAL IN MANCHESTER
|
|
Star date: 28th June 2019 CUADRILLA CASE THREATENS BRITAIN'S PROUD HISTORY OF PROTEST Today, three anti-fracking campaigners face the final day of a trial brought by Cuadrilla which, their legal representatives state, has a "chilling effect on the right to peaceful protest". The protesters are charged at Manchester High Court with breaking an injunction at the Preston New Road fracking site in Lancashire and could face up to two years in jail if found guilty. The trial has huge implications for Salford. Full details here...

Today, three anti-fracking campaigners – Katrina Lawrie, Lee Walsh and Christopher Wilson - face the final day of a trial at Manchester High Court, which their solicitor Simon Pook of Robert Lizar Solicitor, states "has a "chilling effect on the right to peaceful protest... "This is an extremely important case concerning the right to protest and 'persons unknown' anti-protest injunctions which can affect anyone protesting in a particular area" Simon Pook explains "As far as we are aware this is the first time that a company has attempted to bring proceedings against protesters who have allegedly breached a 'persons unknown' injunction." The protesters could face up to two years in prison if convicted of the alleged offences at the entrance to the Preston New Road fracking site in Lancashire in July and August 2018. The case is being brought by Cuadrilla, which argues that the campaigners breached the injunction which prohibited blocking the site entrance and disruption of the company's operations. The case follows the landmark Court of Appeal ruling against fellow fracking company INEOS, earlier this year, when the court ruled that an injunction was unlawful as it was so vague that protesters could not have possibly understood the order. It was also argued during that case that the campaigners' actions were 'reasonable and proportionate', given the importance of the cause and the peaceful nature of the protest. "Injunctions such as this have a chilling effect on the right to peaceful protest" says Simon Pook "Britain has a proud history of protest, it forms the essence of civil society. From the actions of the suffragettes to the 'Blackpool 3', civil disobedience has long been exercised as a form of legitimate protest..." Protesters are expected to gather outside Manchester Civil Justice Centre this morning... Meanwhile, fracking company, IGas, which was at the centre of Salford protests at Barton Moss, has put out a statement informing that the Ellesmere Port appeal that was going to be determined by a Government appointed Planning Inspector has now been called in by the Secretary of State to determine himself. The Government states that the reason for this direction is "That the appeal involves proposals for exploring and developing shale gas which amount to proposals for development of major importance having more than local significance. The Government has made clear in the WMS of May 2018 that it would consider carefully recovering appeals of this nature..." This has further 'chilling' implications for any fracking activity in Salford and beyond, as local democracy is trampled on yet again. Update: 6pm - Campaigners Found Guilty The campaigners were found guilty of a breach of the injunction but they will not be sentenced until September. Judge Pelling set out he will not be sending them to prison. All other options remain...

| No Ray , I am not taking the mick as you put it, I am certainly not joking. If Dennett and all the crackpot nutters bring in the congestion charge, our cars will go. There are already 6 of us ready to start our little trike peloton.I of course will be wearing the yellow jersey. This will be a great laugh, and although I am pretty fit for my age, some of my pals are not.The exercise will be great for them and keep them out of the boozer during the day. An idea we came up with last night was to paint a letter of the alphabet on the box at the front of each trike. Another idea we had was handicapping the riders. As we will all be in very low geared trikes, travelling slowly, we came up with the idea of putting a few bricks to keep the fitter riders slow.Like I have said before, all this so called pollution comes from these filthy diesel buses, not low emission cars, you can see it. They will produce even more filth when they are travelling behind a peloton of eco tri-cyclists. |

| Well, I just got it wrong again. must be old age. It seems horses are not allowed in bus lanes .I was sure they were. Well I will just have to settle for a fleet of non motorised trikes,i.e.the little trikes with a big box and two wheels at front like ice cream sellers at italian resorts used to have years ago. just think how slow you could peddle them with a fleet of Dennetts double deckers behind.Imagine all the motorists in a traffic jam in the outside lane, the ones getting stung with congestion charge, they would all toot their horns with delight as you rode past.Come on Den, make my day. |

| Here he goes again. Trafford, Tory(it was then) Trafford refused licences and nothing happened. Salford issued the licences. With regards to congestion charge, well if Labour bring this charge in, I will gladly give up my ultra eco car. I have already plans in place for this scenario. I will not be going on the bus,as I will be busy starting my new career . I will become a rag and bone man. Imagine it,down the bus lane(Horse drawn vehicles are allowed here) ,Salford precinct, down the crescent ,all the way to town each morning in the rush hour,Steptoe and son theme blasting out.RAG BONE! RAG BONE! Of course Dennett would go bonkers about this, that's what I'd want him to do. He would ban horses from bus lanes. Of course if he did this I would have to recruit my own little cavalry squadron from the nice young dollys who ride horses in Cheshire.I already know a couple of old hags who ride them. You know what this lot are like about rights for horses. Bring it on Den, bring it on. |

| Rayofsunshine yet again saying the Council didn’t have a choice as they don’t have the money. It’s funny how they find multiple millions for office blocks, stadiums and gardens, though. They could fight if they wanted and set a precedent, they just don’t have the spine or just straight don’t want to. |

| Whilst I strongly disagree with the council's decision to allow fracking,Bob the regular,Salford was faced with ruinous legal fees for court cases if it refused fracking licences!
Now that you've freed your inner green warrior,Bob the regular, are you now supportive of congestion charging and motorists bearing the full environmental/social costs associated with having à private motor vehicle? |

| You're wrong White. The feckless leftie wasters that I describe are just that. Very often they are rebels without a cause, so they jump on any cause. They're invariably white and middle class. Oh and I'm not being racist, if you don't believe me then look at a protest, it will be a sea of white people, and if you talk with any of them, they'll invariably turn out to be middle class as well. The thing is these people have nothing better to do with their lives. They also have a Saviour Complex. Personally I find these clowns to be an absolute joke, and more than that, a disgrace. Yes, a disgrace. And whether I have paid taxes and contributed is neither here nor there. For I contribute on here, my pearls potentially nourishing the minds of readers needing wisdom. |

| Rossi’s lefty feckless wasters are mostly either employed or retired after a lifetime of work. They are contributing tax payers or have been for decades.
Can Rossi admit to being or having been such?

| These lefties are feckless wasters and absolute no marks. They're always complaining but never contributing. They're also full of envy of those who have something, and the middle class lefties are the worst, being full of self loathing for having had a comfortable life in the suburbs. What these losers fantasise about is growing up on a council estate and being skint. They're pathetic. Stalin would have had a field day with these useful idiots, sending them off to do some slave labour in a Siberian nickel mine. |

| @Last man standing
I agree that voting should be compulsory for all, but then what you have is people protesting the outcome because they don't like the result, not my Prime Minister/President (even though patently they are).
Back to the fracking and Peterloo, can you imagine back in the times of the Peterloo massacre if people would have campaigned to have the pits closed because of climate concerns, the authorities wouldn't have had to arrest them they'd have been strung up from the nearest tree by the workers themselves. |

| In this bi- centenary year of Peterloo, I'm still amazed at some of the responses. Next time let's send the yeomenry in to break up the protesters. " sabres at the ready chaps"
The reasoning that only the middle class protest, is this born of know your place, djb. When the turnout for elections in Salford rarely goes above a third of the electorate, deeply ingrained apathy is the more likely answer. |

| Yet again we get left wing morons breaking the law and crying foul when brought to justice.
Commit the crime do the time as the saying goes.
They should also be held accountable for the charges of policing the operation, bet they will be upset when the Police say they've run our of money early and can't pop on nice multi coloured clothes and distribute peace lilies at Pride or stop people from using horrible nasty names on Twitter. |

| peaceful protest is standing on a pavement with banners etc shouting protests .This does not include climbing on waggons ,dossing down in the middle of the road, blocking the Queens highway. I don't have a problem with these people though, as I also am anti fracking. Anti fracking on the grounds that ordinary people get no benefit out of it,only greedy oil companies. You know ,I bet all these nice anti fracking people ,apart from a few greens, all voted Labour. These people are all Jezza supporters, yet it was SAlford Labour Council in their greed for money that allowed this fracking. The wicked Tories in Trafford would not allow fracking in Trafford. Whats our Ray got to say about that? These people are not going to jail, they might if they keep on breaching this order. This looks like a case that is going to the supreme court. It will be a great earner for the lawyers. |
